1. About these terms
These Terms of Service (“Terms”) govern your use of beaconcapitalservices.com (the “Site”) and any phone, SMS, or email communication with Beacon Capital Services LLC (“BCS”, “we”, “us”). By using the Site or communicating with us, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.
2. What we do (and don't)
BCS is a Texas-based lead generation and referral service. We connect homeowners with licensed real estate agents, mortgage loan officers, HUD-approved housing counselors, and other professionals who may be able to help with a property situation.
BCS is not:
- A licensed real estate brokerage or sales agent. Real estate services are provided by independent licensed partners.
- A direct buyer of property. We do not make offers on or purchase homes ourselves.
- A law firm. Nothing on the Site, in our texts, or in any conversation with us is legal advice. For legal questions, consult a qualified attorney.
- A government agency or HUD-approved counselor. For a free HUD-certified counselor, visit hud.gov/counseling.
- A debt collector, foreclosure rescue service, or mortgage modification provider.
Our service is free to homeowners. We're compensated only when a transaction closes through one of our licensed partners and that partner pays us a referral fee — never by you directly.
3. Who can use the service
You must be at least 18 years old, a legal resident of the United States, and either the owner of the property in question or authorized to discuss it (executor, trustee, etc.). Our active service area is the Dallas-Fort Worth and Houston metro regions of Texas. If you contact us about a property outside that area, we'll do our best to point you to an appropriate resource but may not be able to help directly.
4. Acceptable use
You agree to use our Site and communications for legitimate inquiries about your real property situation. You won't:
- Use the Site to scrape, harvest, reverse-engineer, or otherwise extract data beyond normal browsing.
- Submit our intake form, send us SMS, or call us on behalf of someone else without their authorization.
- Use BCS for unlawful purposes, fraud, harassment, or to interfere with our service.
- Impersonate another person.
5. Calls, SMS, & email
SMS is opt-in. We only send texts to numbers that have explicitly consented — by submitting our web form, by verbal agreement during a phone call, or by texting us first. Reply STOP to any text at any time to opt out.
By providing your phone number on our form or verbally during a call, you consent to receive calls and SMS from us about your inquiry. Message frequency varies based on the conversation we're having. Message and data rates may apply per your carrier's plan. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for full SMS terms.
Outbound calls from BCS originate from +1 (945) 300-5040. We dial only during legal calling windows. We scrub against federal Do Not Call, the Texas No Call List, and our internal DNC before every call. If you tell us to stop calling, we will — and that opt-out applies to every member of our team.
6. Fees & referrals
BCS does not charge homeowners. We may receive a referral fee from licensed partners (real estate agents, mortgage loan officers, etc.) when a transaction closes that we introduced. The fee is paid by the partner from their commission or revenue. It does not increase the cost of the transaction to you.
You're always free to choose your own agent, lender, or counselor. We don't condition any conversation or referral on you agreeing to use a specific partner.
7. Disclaimers
The Site and our communications are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that:
- Any specific outcome (a sale, a refinance, avoiding foreclosure, etc.) will be achieved.
- Any partner will accept your case or offer specific terms.
- Information on the Site is complete, accurate, or current. Real estate markets, laws, and lender programs change frequently.
- The Site or our communications will be uninterrupted or error-free.
Every property situation is unique. Consult a licensed attorney for legal advice, a licensed financial advisor for financial advice, and a HUD-approved counselor for free housing counseling specific to your case.
8. Limitation of liability
To the maximum extent permitted by law, BCS and its members, employees, contractors, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our communications, including but not limited to lost profits, lost data, or business interruption. Our total liability for any direct damages will not exceed $100.
You agree to indemnify and hold BCS harmless from claims arising out of your breach of these Terms or your unlawful use of the Site.
9. Governing law & disputes
These Terms are governed by the laws of the State of Texas without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Dallas or Collin County, Texas, and you consent to that jurisdiction.
Before filing any formal proceeding, you agree to first contact us at torrey@beaconcapitalservices.com with a description of the dispute. We commit to a good-faith response within 30 days. Many disagreements resolve at this step.
10. Changes & contact
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent version. Material changes will be posted to the home page for at least 30 days before they take effect. Continued use of the Site after that period constitutes acceptance.
